DREAMCATCHER BY PAULA GLANC ONLINE STORE TERMS AND CONDITIONS

1. GENERAL PROVISIONS

1.1. Application of the Regulations

  1. The regulations specify:
    a) the types and scope of services provided electronically within the Online Store,
    b) terms of use of the Online Store,
    c) conditions for concluding and performing Sales Agreements,
    d) complaint procedure,
    e) the principles of the Seller’s liability towards Customers and information on the right to withdraw from the contract and exceptions to this right.

  2. The sale of products takes place in accordance with the Regulations and generally applicable provisions of Polish law.

  3. The Regulations constitute a standard contract within the meaning of Article 384 § 1 of the Civil Code.

1.2. Online Store and Seller

  1. The owner and operator of the Dreamcatcher by Paula Glanc Online Store, operating at www.dreamcatcher-pg.com , is Paula Glanc , operating under the name "Firma Produkcyjno-Handlowa DREAMCATCHER Paula Glanc" , business address and correspondence address: ul. Króla Kazimierza Wielkiego 62, 32-300 Olkusz , entered into the CEIDG, NIP 637-21-96-706 , REGON 362940932 (hereinafter referred to as the "Seller").

1.3. Contact

  1. The Customer may contact the Seller:

    d) by phone: 503-153-850 (cost according to the Customer's operator's tariff).

1.4. Definitions

  1. Whenever the Regulations refer to:
    a) Business Day – this shall be understood as a day from Monday to Friday, excluding public holidays,
    b) Customer – this shall be understood as a natural person, legal person or organizational unit without legal personality who uses the Online Store or concludes a Sales Agreement,
    c) Consumer – this shall be understood as a Client who is a natural person performing a legal act not directly related to his or her business or professional activity,
    d) Entrepreneurs with consumer rights – this should be understood as a natural person concluding a contract directly related to his/her business activity, when the content of the contract indicates that it is not of a professional nature for that person,
    e) Product/Goods – this shall be understood as a movable item available in the Online Store that is the subject of the Sales Agreement,
    f) Regulations – this shall be understood as these Regulations,
    g) Online Store – this should be understood as the website operated by the Seller at www.dreamcatcher-pg.com ,
    h) Sales Agreement – ​​this shall be understood as a contract for the sale of Goods concluded at a distance between the Customer and the Seller via the Online Store.


2. RULES OF USE OF THE ONLINE STORE

2.1. Technical conditions

  1. To use the Online Store, it is not necessary to meet any special technical requirements other than standard Internet access and an up-to-date web browser.

  2. The Store may use cookies in accordance with the information provided in the Store.

2.2. Language

  1. The Online Store is run in Polish.

  2. Contracts are concluded in Polish.

2.3. Time and Territory

  1. Sales are based on Central European Time (CET/CEST).

  2. Sales are conducted in the territory of the Republic of Poland and in the Member States of the European Union (unless the Store indicates otherwise). The delivery address must be within the EU.

2.4. Products and Prices

  1. Goods available in the Online Store are presented with photos, descriptions and prices.

  2. Photos of the Goods are for illustrative purposes only – the Goods are handmade/crafted, therefore slight differences may occur due to, among other things, the production process or screen settings.

  3. The price listed on the Store's website at the time of ordering is binding. Shipping costs may be added to the price, as selected by the Customer during the purchasing process.

  4. Information about the Goods (including description, photos and price) constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.

2.5. Customer Account

  1. The Store may allow you to create a Customer Account. Registration is voluntary and free of charge.

  2. The customer is obliged to provide true data.

  3. The Customer may delete the Customer Account at any time – in accordance with the functionalities of the Store or by contacting the Seller.

  4. Complaints regarding the operation of the Account/Electronic Services may be submitted to the contact details provided in point 1.3. The Seller will respond within 14 days.

2.6. Personal data

  1. The principles of personal data processing are specified in the Privacy Policy available in the Store.


3. RULES FOR CONCLUDING A SALES AGREEMENT

3.1. Conclusion of the Sales Agreement

  1. The Sales Agreement is concluded when the Customer places an order via the Store (button "Order and pay" / "Buy and pay") and the Customer receives confirmation of acceptance of the order to the e-mail address provided.

  2. The Customer places an order by adding Goods to the basket, completing the order form, selecting delivery and payment, and accepting the Regulations.

3.2. Order Confirmation

  1. After placing the order, the customer receives an e-mail confirming that the order has been accepted for processing.


4. RULES FOR PERFORMING THE CONTRACT

4.1. Payment

  1. The Store allows the following payment methods (depending on the current configuration in the Store):
    a) traditional transfer,
    b) Przelewy24 (PayPro SA) ,
    c) PayPal,
    d) cash on delivery (if available),
    e) deferred payment/installment payment via PayPo .

  2. The payment method is selected during the ordering process.

4.2. Przelewy24 – information provisions

  1. Online payments within Przelewy24 are made by an external payment operator.

  2. Using Przelewy24 may require acceptance of the payment operator's regulations and compliance with technical/organizational conditions provided by the operator.

  3. Customer data may be transferred to the payment operator to the extent necessary to complete the transaction – in accordance with the operator’s rules and the Privacy Policy.

4.3. PayPo – information provisions

  1. If you choose PayPo payment, the payment/installment deferral service is provided by an external entity – PayPo.

  2. Using PayPo may require acceptance of PayPo regulations and a positive assessment of the possibility of using the service made by PayPo.

  3. Customer data may be transferred to PayPo to the extent necessary to process transactions and provide the service – in accordance with PayPo rules and the Privacy Policy.

4.4. Payment deadline for traditional transfers

  1. If the Customer has chosen to pay by traditional transfer, he/she should make the payment within 7 days of placing the order, unless the Store indicates otherwise.

  2. Failure to pay on time may result in the order being canceled.

4.5. Order fulfillment

  1. The seller begins processing the order after the payment has been received or after receiving confirmation from the payment operator.

  2. Goods are made to order. The delivery time is indicated in the Store (e.g., in the Product description or in the shopping cart) and may depend on the type of order and production load.

  3. The fulfillment of an order involves production (sewing), completion, packaging and handing over the shipment to the carrier.

4.6. Delivery

  1. Deliveries are made via the operators indicated in the Store.

  2. The delivery cost is presented to the customer before placing the order.

  3. The order is accompanied by a sales document compliant with tax regulations.


5. COMPLAINT PROCEDURE AND WITHDRAWAL FROM THE CONTRACT

5.1. Complaints – general rules

  1. The Seller is liable to the Customer for the compliance of the Goods with the Agreement under the principles arising from generally applicable provisions (in particular in relations with the Consumer and the Entrepreneur with consumer rights).

  2. The complaint should be submitted in a manner enabling the Seller to become familiar with its content:
    a) e-mail: dreamcatcherbypg@gmail.com , or
    b) by mail: ul. Króla Kazimierza Wielkiego 62, 32-300 Olkusz , or
    c) by mail: ul. Kruczkowskiego 6b/15, 00-380 Warsaw .

  3. The complaint should include at least: name and surname, contact details, order number (if applicable), description of the problem and the Customer's request.

  4. The Seller will respond to the complaint within 14 days of its receipt.

  5. In justified cases, the Seller may ask the Customer to deliver the Goods for complaint evaluation. If the complaint proves justified, the Seller will reimburse the Customer for the reasonable shipping costs of the complaint or arrange for collection – to the extent agreed with the Customer.

5.2. Withdrawal from the contract – general information

  1. As a rule, the Consumer has the right to withdraw from a distance contract within 14 days without giving any reason, unless a statutory exception applies.

5.3. No right of withdrawal – Custom-made goods

  1. The Store offers Goods made to individual customer orders (made/made after placing the order, in accordance with the Customer's choice, in a manner corresponding to his/her individual needs).

  2. In connection with the above, the Customer who is a Consumer or an Entrepreneur with consumer rights is not entitled to withdraw from the Sales Agreement if the conditions of the statutory exception regarding non-prefabricated goods, manufactured according to the Customer's specifications or intended to meet his individual needs, are met.

  3. The lack of the right of withdrawal (return) does not exclude or limit the right to file a complaint in the event of non-compliance of the Goods with the Agreement.

5.4. Exchanges

  1. The Store does not have a standard procedure for exchanging Goods. Individual arrangements may be made directly with the Seller, without prejudice to the Customer's rights arising from complaints.

5.5. Extrajudicial methods of handling complaints and pursuing claims

  1. The consumer may use out-of-court dispute resolution methods, in particular by:
    a) contacting the locally competent municipal/district consumer ombudsman,
    b) submitting a request for mediation to the Provincial Inspectorate of Trade Inspection,
    c) use of arbitration courts at the Trade Inspection (if appropriate).

  2. Detailed information is available from consumer ombudsmen and the Trade Inspection, among others.


6. FINAL PROVISIONS

6.1.

The Regulations are available on the Store's website in a form that allows them to be saved, downloaded and printed.

6.2.

None of the provisions of the Regulations exclude or limit the rights of Consumers and Entrepreneurs arising from mandatory provisions of law.

6.3.

The Seller may amend the Terms and Conditions for important reasons (e.g., changes in legal regulations, changes in payment or delivery methods, changes in Store functionality). Changes to the Terms and Conditions do not apply to orders placed before the changes come into effect.
